CC No.203 of 2022.

Narender Kumar         Versus     Star Health.

 

Present:          Complainant in person with Sh. Adesh Gupta, Adv.

                       Sh. Rajiv Kumar Gupta, Adv. for the respondent No.2.

                       (Notice of complaint was not ordered against respondent No.1&3).

           

                     On the basis of even dated application filed by the complainant, file taken up on today. Both the parties submitted they have entered into compromise. When the parties have entered into amicable settlement, then this Commission should not become stumbling block in the way of parties to dispose off the matter. Parties/counsels for parties are permitted to make their statement. Counsel for the respondent No.2 suffered statement, agreeing to pay Rs.1,49,000/- in lump-sum to the complainant within the period of 45 days from today. Complainant alongwith his counsel suffered statement, agreed to the statement of Sh. Rajiv Kumar Gupta, Adv. for the respondent No.2.

                    In view of the statement of the complainant as well as Sh. Rajiv Kumar Gupta, Adv. for the respondent No.2, without making any adverse comment on the act and conduct of the respondent No.2, as the matter has amicably settled between the parties, the complaint is accepted against the respondent No.2, holding it liable to pay Rs.1,49,000/- (Rupees One Lac Forty Nine Thousand) in lump-sum to the complainant within the period of 45 days from the date of order, in default of it, respondent No.2 shall be liable to pay simple interest @8% per annum from the date of order till actual realization. Parties are left to bear their own cost of litigation.  File be consigned to records.
