CC No.83 of 2023.

Ashu         Vs.    Star Health.

 

Present:     Sh. Manoj Kumar Kamboj, Adv. for the complainant.

                  Sh. Naveen Kumar Kaushal, Adv. for the respondent No.1.

                  (Notice of complaint was not ordered against the respondent No.2).       

    

                On the basis of even dated application filed by Sh. Naveen Kumar Kaushal, Adv. for the opponent No.1, file taken up on today. Opposite counsel also present before this Commission and endorsed his no objection report on the application. The parties have entered into compromise and on behalf of the respondent No.1, Sh. Naveen Kumar Kaushal, Adv. suffered statement to make payment of Rs.81,000/- to the complainant as full and final settlement within the period of 45 days. Counsel for the complainant agreed to it. Statement of counsel for the respondent No.1 and counsel for the complainant recorded.

             Keeping in view statement of counsel for the respondent No.1 and counsel for the complainant, without making any adverse comment on the act and conduct of the respondent No.1, matter being amicably settled, the complaint is accepted, holding the respondent No.1 Star Health and Allied Insurance Company Ltd., liable for making payment of Rs.81,000/- (Rupees Eighty One Thousand) only to the complainant as a full and final settlement of the matter, within the period of 45 days from today, in default of it, the respondent No.1 shall be liable to pay simple interest @ 8% per annum on the award amount from the date of order till actual payment. Reader of the Commission directed to incorporate the entry in the relevant register regarding disposal of the complaint on today. File be consigned to the records.
