ORDER

CC No.48 of 2024.

Vijay Laxmi      Vs.     Star Health.

 

Present:          Complainant with Ms. Kirti Gupta, Adv. as proxy for Sh. DS Khurana, Adv.

                       Sh. Naveen Kumar Kaushal, Adv. for the opponent.     

                         

                      On the basis of even dated application filed on behalf of the opponent, file taken up on today. The complainant also present before this Commission. The parties have entered into amicable settlement and Sh. Naveen Kumar Kaushal, Adv. on behalf of the opponent, offered payment of Rs.2,68,000/- to the complainant, as full and final settlement of the matter, within the period of 45 days from today.  The complainant accepted the offer made by counsel for the opponent. Statement of counsel for the opponent and the complainant recorded. The complainant is duly identified by Ms. Kirti Gupta, Adv., bearing Enrollment No. P/3489/2019.

                Keeping in view the statement made by the counsel for the opponent and the complainant, without passing any adverse comment on the act and conduct of any of the parties, matter being amicably settled between the parties, the complaint is, partly, accepted, against the opponent, holding it liable to make payment of Rs.2,68,000/- (Rupees Two Lac Sixty Eight Thousand only), to the complainant, as full and final settlement of the matter, within the period of 45 days from the date of order, in default of it, the opponent shall be liable to make payment of simple interest @8% per annum from the date of order till actual payment. The Reader of this Commission is directed to record the necessary entry in the relevant register or computer, showing the final disposal of the complaint on today instead of 18.11.2024. Certified copy of this order be supplied to the parties free of costs. File be consigned to records.
