Manoj Vs. Star Health

Present:           DH in person with Sh.Digvijay Jakhar Advocate.

                        Sh. Gulshan Chawla, Advocate for JD.

                        File taken up today on the application of ld. counsel for the JD for depositing the awarded amount before the Forum as per order of Hon’ble State Commission, Haryana Panchkula in FA No.853 of 2019. Order perused. Application allowed. In compliance of order dated 14.11.2019 of Hon’ble State Commission, Haryana, Panchkula, ld. counsel for the JD has placed on record a cheque no.593944 in favour of the complainant/DH.

                        DH made a statement that he had received a cheque/DD No. 593944  dated 28.11.2019 amounting to Rs.297931/- in compliance of order dated 14.11.2019 in FA No.853 of 2019 passed by the Hon’ble SCDRC, Haryana, Panchkula. It is further stated that in case any adverse order is passed by the Hon’ble State Commission , Panckhuka,  he as well as his surety Sandeep Singla will be liable, to reimburse amount to the JD. It is further stated that he withdraw the present execution petition subject to the decision by the Hon’ble State Commission, Haryana, Panchkula.

                        Surety Sandeep Singla also made a statement that in case any adverse order is passed by the Hon’ble State Commission, Haryana, Panckhuka,  he as well as Manoj Singla will be liable to reimburse amount to the JD. He also submitted proper detail of Registered Sale deed No.838 dated 18.10.2007.  

                        In view of the above statements made by the parties, present execution is hereby disposed as withdrawn.  Papers be attached with the main file.

                        File be consigned to the record room after due compliance.
