Present:          Sh.Vinod Kaushik, Adv. for complainant.

                        Sh.Avinash Sardana, Advocate for OPs.

 

ORDER:

                   File taken up today (11.08.2023) on the application moved by the learned counsel for the complainant.

                   Learned counsel for the OPs has made a statement that the insurance company has compromised the said complaint with the complainant for full and final settlement of Rs.50,000/-. The insurance company shall deposit the said amount within two months from the date of this order.

                   The learned counsel for the complainant has made a statement that he is agreed with the statement of learned counsel for the OPs and the award be issued accordingly.

                   Keeping in view the statement made by learned counsel for both the parties, the present complaint is disposed off with the direction the Star Health and Allied  insurance company shall make the payment of Rs. 50,000/- within two months from the date of passing of the order, if the insurance company fails to make the payment of aforesaid amount within two months, the insurance company shall be liable to pay interest @9% per annum from the date of filing of complaint till payment. It is directed that both the parties shall remain bound by their own statements. Certified  copy of order be supplied to the parties free of cost.

                    File be consigned after due compliance.
