Heard Sh. Arun Kumar, Counsel for OP. Perused file. It is true that none is appearing for the complainant since last dates of hearings i.e. 13.10.2015, 08.02.2016, 07.04.2016, 18.10.2016, 02.01.2017, 13.02.2017, 07.07.2017, 02.11.2017& 31.01.2018 consecutively. Several calls have been given since morning. But none on behalf of the complainant has appeared. Moreover, Court notices to the complainant have been issued for appearance on 02.01.2017, 10.02.2017 & 07.07.2017. But the court notices could not be delivered on the complainant due to reason ‘item delivery attempted-unclaimed’. There is no other address of the complainant on record.

It appears that complainant is not interested in perusing his case. It will be abuse of process to proceed further in the absence of the complainant. Hence complaint is dismissed in default for the reasons mentioned above.

File be consigned to record room.
