Both parties are present by filing. The complainant is present in person. Today is fixed for filing written version by the op. Today the op has submitted one demand draft drawn on HDFC Bank in the name of the complainant being no. 267174, dated 31.3.2016 to the tune of Rs. 89,663=00 along with a petition. The complainant has also filed one settlement petition stating that the dispute by and between him and the op has been amicably settled out of court and for this reason he is not willing to proceed with this complaint further. Prayer has been made by the complainant for passing an appropriate order by this ld. Forum. Upon considering the two petitions of the parties and hearing verbal submission we are of the view that as the grievance of the complainant has already been settled amicably out of court and in this connection the complainant has filed a settlement petition, hence the complaint being no. 213/2015 is dismissed for non-prosecution.

As the draft has been deposited by the OP before this ld. Forum hence the complainant is at liberty to collect the same from the office of this ld. Forum by making an application along with producing valid photo identity before the appropriate authority.

The complainant has submitted an application praying for withdrawal of the above-mentioned draft along with electoral card (original and photocopy). The original electoral card is returned to the complainant after tallying with the photocopy. Hence the office is directed to hand over the above-mentioned draft to the complainant forthwith.
