Complaint u/s 12 of the Consumer Protection Act.

                   An application for putting up the case file and for compromising/settlement the matter has been filed by learned counsel for the OP. Heard. In view of the facts mentioned on the application, same stands allowed. File taken up. Instant notice has been issued to the counsel for the complainant. On notice, learned counsel for the OP complainant.

                   Learned counsel for the OP made a statement that Star Health Company is ready to make payment of ₹31,000/- to the complainant within fifteen days.

                   On the other hand, learned counsel for the complainant made a statement that if the company pays ₹31,000/- today, then he is withdraws the present complaint. He further stated that if company resiles from his statement, then he reserves the right to file a fresh complaint on the same cause of action. 

                In view of statement of complainant, the present complaint is dismissed as withdrawn. It is made clear that in case company fails to make payment to the tune of ₹31,000/- to the complainant within fifteen days, then the complainant reserves right to file the fresh complaint on the same cause of action. File be consigned to the record room after due compliance.
