Today matter is listed for arguments on admission. During the arguments it reveal that present complaint has been filed by Manoj Kathuria who has no locus standi against OP since the claim rejected by OP  pertains to Lalita who happens to be the mother of the Manoj Kathuria who is the Complainant. Since Lalita is also her insured in the policy concerned. Therefore the Complaint should be filed in the name of his mother.  At the stage, counsel for complainant wants to withdraw the complaint with liberty to file afresh with fresh facts. Heard allowed. Matter is dismissed as withdrawn. Limitation, if any be waived off in the interest of justice. File be consigned to record room.
