Final Order / Judgement

Complainant has filed the present complaint on the allegations that her husband purchased health Insurance policy for his father and mother bearing no.P/211222/01/2021/002040 for the period 16.07.2020 to 15.07.2021. Unfortunately on 10.04.2021 his father suffered some health complication and got admitted in Delhi Heart Institute and Multispecialty Hospital, Moga and got discharged from the hospital on 16.04.2021, where an amount of Rs.90,627/- was incurred. However, unfortunately, he died on 28.10.2021. Further alleged that after the death of father of husband of complainant, her husband submitted the claim form alongwith all medical records with Opposite Parties on 26.12.2021 and vide this complaint claimed that Opposite Parties are not paying the claim amount.

Perusal of the record reveals that there is no record on file revealing that the claim was ever lodged with Opposite Parties. Furthermore no repudiation/rejection letter is produced on record. Ld. counsel for the complainant only relying upon Ex.C9 i.e. claim form, but perusal of the same nowhere reveal that claim has been lodged with the Opposite Parties under proper dispatch receipt. So, the present complaint is not maintainable being pre-mature and is being returned. Extra sets of the complaint are also ordered to be returned. Copy of the order be supplied to the complainant free of costs. File be consigned to record room after compliance.
