ORDER

Renu Devi Vs. Star Health and Allied Insurance CC-26/2024

Present:          Sh. Anand Singh Dabas, Advocate for complainant.

                                                                       

                        Today the case is fixed for consideration on the maintainability of the present complaint.

                    Heard.

                    The complainant failed to place on record any cogent or authentic document  and policy for the insurance  in support of his complaint. Further, the facts mentioned in the legal notice and the complaint, more particularly name of the nominee and amount of sum insured vary, which cast doubts about authenticity of facts mentioned in the complaint. The doubt further exaggerated when  no document/evidence was find attached to the complaint in favour of the claim. The onus lies on the complainant to satisfy this Commission for issuing notice  to the OPs which is totally missing in the complaint.

                        Hence, prima-facie, we opine that it is not a fit case for summoning of OPs by issuing notice by this Commission. Therefore, the complaint of complainant being not maintainable in the present form, deserves dismissal and hence, the same is hereby dismissed.

                        Copy of the order be supplied to complainant free of cost. File be consigned to the record-room.
