Final Order / Judgement

              Sh.R.P.Singh, Adv.counsel for the opposite party

 

          Reply to the application by the opposite party not filed. Counsel for the opposite party got recorded his statement that opposite party is ready to settle the claim on the basis of terms and conditions of the policy if the complainant provides all original bills and other required documents to the opposite party within 15 days and the company will settle the claim within one month from the date of receipt of complete documents. In view of the above statement, Sh.M.K.Sharma, Adv.counsel for the opposite party got recorded his statement that he has heard the statement of the counsel for the opposite party and agreed with the same and stated that complaint may kindly be disposed of.

           Since the opposite party is ready to settle the claim of the complainant on the basis of terms and conditions of the policy, as such, in our considered opinion, it is a fit case which can be disposed of by giving directions to both the parties. Consequently, present complaint is disposed of with directions to the complainant to provide all original bills and other required documents to the opposite party within 15 days from today and opposite party is directed to settle the claim of the complainant either way  within one month from the date of receipt of complete documents from the complainant.  If the complainant is not satisfied with the decision of the opposite party, he is at liberty to file a fresh complaint. Copy of the order be furnished to the parties free of costs. File be consigned to the record room.
