Complaint under Section 35 of the Consumer Protection Act, 2019

Today, the case was fixed for leading evidence by the OPs, subject to payment of costs of Rs.400/-, to the complainant. Cost Paid. Learned counsel for the OPs No.1 and 2 has suffered a statement, which is recorded separately, to the effect that the matter has been compromised between the parties, whereby the OPs are ready to pay a sum of Rs.1,00,000/- (One Lac), in full and final settlement of the entire claim of the complainant in the present complaint. The OPs will make the payment within 30 days from the date of receipt of the certified copy of order. Complainant has also suffered a statement that he has heard the abovesaid statement given by the learned counsel for the OPs No.1 and 2 and agrees with the same and he withdraws the present complaint. Said statement has duly been identified by the learned counsel for the complainant.
In view of the statement suffered by the learned counsel for the OPs No.1 and 2 and the complainant, the present complaint is hereby dismissed as withdrawn. It is made clear that parties shall remain bound by their statements. Certified copy of this order passed in Lok Adalat be supplied to the parties concerned, free of costs, as per rules. File be indexed and consigned to record room, after due compliance.
