ORDER

PER SANJEEV BATRA, PRESIDENT

1.                           The complainant has invoked the jurisdiction of this Commission by raising a consumer dispute against the OP1 with regard to settlement of medi-claim health insurance claim by the OP1 qua the treatment of his son and sought direction to pay the claim amount of Rs.17,170/- along with interest from repudiation of claim along with compensation and litigation expenses etc. So, by filing the present complaint, complainant has prayed that OPs be directed to make the payment of Rs.17,170/- along with interest of @22% per annum from the date of repudiation of claim. i.e. 02.11.2022. Also to pay Rs.50,000/- as compensation and Rs.50,000/- as litigation charges

2.                The complaint was not admitted against OP2 vide order dated 20.03.2023 as there is no specific relief has been claimed against OP2 who is just a hospital.

3.                Notice was issued to the opposite party No.1 and on 13.06.2023 Sh. Rajeev Abhi, Advocate filed power of attorney on behalf of opposite party No.1.  Today, Sh. Rajeev Abhi, Advocate counsel the OP1 suffered statement that he has received the Email dated 10.04.2023 Ex. CA whereby the company is ready to pay Rs.17,170/- in full and final settlement of the claim and redressal of the grievance pending in the present complaint. The company will make the payment within 30 days from the date of receipt of copy of the order.    

4.                The said offer has been duly accepted by Sh. Mohit Verma, Advocate counsel for the complainant by suffering separate statement in this regard. Sh. Mohit Verma, Advocate counsel for the complainant also suffered statement by accepting the offer to pay the amount of Rs.17,170/- in full and final settlement of the claim and an award of the said amount of Rs.17,170/- be passed accordingly in full and final settlement of the claim and redressal of the grievance of the complainant in the present complaint for all times to come.

5.                In view of the aforesaid settlement arrived between the parties through Ex. CA, the present complaint stands disposed of with the direction that the OPs will pay Rs.17,170/- to the complainant in full and final settlement of his claim within 30 days from the date of receipt of copy of this order failing which the complainant shall be held entitled for interest @8% per annum on the said amount till its actual payment. Copy of the order be supplied to the parties free of costs.

6.                File be indexed and consigned to record room.

                   Sh. Rajeev Abhi, Advocate counsel the OPs suffered statement that he has received the Email dated 10.04.2023 Ex. CA whereby the company is ready to pay Rs.17,170/- in full and final settlement of the claim and redressal of the grievance pending in the present complaint. The company will make the payment within 30 days from the date of receipt of copy of the order.                    

                   Sh. Mohit Verma, Advocate counsel for the complainant suffered statement by accepting the said offer and suffered that the complainant accepts amount of Rs.17,170/- in full and final settlement of the claim and an award of the said amount of Rs.17,170/- be passed accordingly in full and final settlement of the claim and redressal of the grievance of the complainant in the present complaint for all times to come.

                   We have perused the record. Vide separate detailed order of today, the present complaint stands disposed of. Copies of order be supplied to parties free of costs as per rules. File be indexed and consigned to record room.
