ORDER

PER SANJEEV BATRA, PRESIDENT

1.                           The complainant has invoked the jurisdiction of this Commission by alleging deficiency in service on the part of the OP and raised a consumer dispute with regard to non-settlement of insurance claim of the complainant and thus sought directions to the OP to disburse the claim amount along with compensation etc. So, by filing the present complaint, complainant has prayed that OPs be directed to disburse the claim amount of Rs.81,953/- along with  compensation of Rs.55,000/- and Rs.25,000/- as litigation charges.

2.                Notice was issued to the opposite party and on 13.06.2023 Sh. Rajeev Abhi, Advocate filed memo of appearance on behalf of opposite party No.1.  Today, Sh. Rajeev Abhi, Advocate counsel filed power of attorney on behalf of the OP and suffered statement that he has received the Email dated 05.05.2023 Ex. CA whereby the company is ready to pay Rs.74,047/- in full and final settlement of the claim and redressal of the grievance pending in the present complaint. The company will make the payment within 30 days from the date of receipt of copy of the order.   

3.                The said offer has been duly accepted by the complainant Sh. Gary Jain along with his counsel Sh. Lakshya Guputa, Advocate by suffering separate statement in this regard acepted the offer to pay the amount of Rs.74,047/- in full and final settlement of the claim and an award of the said amount of Rs.74,047/- be passed accordingly in full and final settlement of the claim and redressal of the grievance of the complainant in the present complaint for all times to come.     

4.                In view of the aforesaid settlement arrived between the parties through Ex. CA, the present complaint stands disposed of with the direction that the OP will pay Rs.74,047/- to the complainant in full and final settlement of his claim within 30 days from the date of receipt of copy of this order failing which the complainant shall be held entitled for interest @8% per annum on the said amount till its actual payment. Copy of the order be supplied to the parties free of costs.

5.                File be indexed and consigned to record room.

                   Sh. Rajeev Abhi, Advocate filed power of attorney on behalf of the OP and also suffered statement that he has received the Email dated 05.05.2023 Ex.                    Complainant Sh. Gary Jain along with Sh. Lakshya Gupta, Advocate suffered statement by accepting the said offer and suffered that the complainant accepts amount of Rs.74,047/- in full and final settlement of the claim and an award of the said amount of Rs.74,047/- be passed accordingly in full and final settlement of the claim and redressal of the grievance of the complainant in the present complaint for all times to come.

                   We have perused the record. Vide separate detailed order of today, the present complaint stands disposed of. Copies of order be supplied to parties free of costs as per rules. File be indexed and consigned to record room.
