1. This complaint is filed under section 35 of Consumer Protection Act 2019 and stood over to this date for consideration and this Commission passed the following order.

2. This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. After admitting the complaint notice was issued to the opposite party. The opposite party entered appearance and filed written version denying the allegations raised by the complainant. When the case came up for consideration on 05/08/2023, both parties represented that there is a chance of settlement and hence the matter was referred for mediation. When the case came up for consideration today, both parties submitted that the matter is settled for Rs.21,883/- (Rupees twenty one thousand eight hundred and eighty three only). As per the terms of the compromise the opposite party has agreed to pay the said amount within two weeks from the date of settlement. The compromise memo signed by both parties was also filed before this commission. The above said compromise memo dated 23/09/2023 is accepted and recorded. In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be allowed in terms of compromise.

                   In the result, the complaint is allowed in terms of compromise. The compromise memo dated 23/09/2023 shall form part of this order. There will be no order as to costs.

          A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.

     Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the Open Commission, this the 23rd September 2023.
