ORDER
SRI. P. V. JAYARAJAN: PRESIDENT
This complaint is filed under Sec. 35 of the Consumer Protection Act, 2019 and the matter stood over to this date for consideration. After hearing the matter this Commission passed an order as follows:
This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. After admitting the complaint, notice was issued to the opposite party and the same was accepted by the opposite party on 23.04.2024. The opposite party entered appearance and filed written version denying the allegations raised by the complainant. When the case came up for consideration on 20.05.2024, both parties submitted that there is a chance of settlement and hence the matter was referred for mediation. When the case came up for consideration today, both parties present and submitted that the matter is settled. A compromise memo signed by both parties is also filed before this Commission. As per the compromise, the opposite party agreed to pay Rs. 4,00,000/- (Rupees Four Lakhs only) to the complainant within 30 days from the date of this settlement. The compromise memo dated 06.07.2024 is accepted and recorded. In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be allowed in terms of the compromise.
In the result, the complaint is allowed in terms of the compromise. The compromise memo dated 06.07.2024 shall form part of this order. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
