ORDER

SRI. P. V. JAYARAJAN:  PRESIDENT

          This complaint is filed under Sec. 35 of the Consumer Protection Act, 2019 and the matter stood over to this date for consideration.  After hearing the matter this Commission passed an order as follows:

This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party.  After admitting the complaint notice was issued to the opposite party.  Opposite party entered appearance and filed written version denying the allegations raised by the complainant.  Subsequently the case was adjourned to 04.09.2024 for filing proof affidavit of the complainant.  Meanwhile, the parties to the proceedings filed a settlement memo stating that the matter is settled.  In order to consider that memo this Commission suo moto advanced this case from 04.09.2024 to this date.  As per the compromise the opposite party has agreed to pay Rs. 35,000/- to the complainant within 30 days from today. The settlement memo signed by both parties is accepted and recorded.  In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be allowed in terms of the compromise.  

In the result, the complaint is allowed in terms of the compromise.  The compromise memo dated 22.06.2024 shall form part of this order.  There will be no order as to costs. 

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
