The petition is filed by the respondent/opposite party in CC.4/08 contending that the order in I.A.40/10 that restored the complaint dismissed for default is illegal, perverse etc. It is the contention of the petitioner that the Commission is not having the power to restore a complaint dismissed for default.
We find that the petition cannot be sustained in view of the fact that the Consumer Protection Act does not confer power on the State Commission to review its own orders. Further the CDRFs and State Commission are having power to restore the complaints dismissed for default in the light of the decision of the Supreme Court in New India Assurance Co. Ltd Vs. Sreenivasan, 2000 KLT 385, Abdul Azeez Sait Vs. Penta Alpha Marketing Agencies (P) Ltd. 2003 (3)KLT S 88; St. Joseph Hospital Vs. Jimmy, 2001 (2) KLT 514 and Kumar Vs. Bincy 2009 (1)KLT 544. Hence the Review Petition 32/10 is dismissed here with.
