ORDER

 

                    Arguments on the point of admissibility heard.

                    The complainant has filed the present complaint against the opposite party on the ground that he has stopped use of Card No.220760010012010 issued in Oct, 2006. The reason for stopping card usage was that the OP was repeatedly not delivering card statements on time. However, all the amounts of the said car have duly been paid by the complainant though opposite party was demanding overdue payment. The complainant has applied for second hand car loan in Jan, 2016 which was rejected due to CIBIL score. The OP has submitted misleading information to CIBIL which has harassed the complainant when he was not at fault. Due to loan rejection the complainant was subjected to extreme financial hardship. The complainant has alleged deficiency in service on the part of the opposite party and has sought compensation of Rs.90,000/-.                 

                    However, after going through the facts and circumstances of the case, we are of the opinion that the cause of action if any accrued in favour of the complainant and against the CIBIL as held by this Forum in other connected  Consumer Complaint No.161 of 2016 and 162 of 2016 which are  being decided simultaneously. Since the complainant is not a consume as defined u/s 2)1)(d) of Consumer Protection Act, 1986, because the OP has not sanctioned IInd loan and thus the complaint itself is not maintainable before this Forum and as such the present complaint is hereby dismissed. Copy of this order be supplied to the complainant free of costs.

                   File be consigned to the records after due compliance.
