Consumer Complaint No.196 of 2012

 

Jeewan Gupta        Vs.     Standard Chartered Bank & anr.

Sh.Jaspinder Singh, Area Manager of OP No.1 and Sh.Sourabh Bindra, Counsel for OPs.

ORDER         

 

1.         An application has been filed on behalf of OPs praying therein for setting aside the order dated 27.11.2012 whereby OPs were proceeded as ex-parte. Sh.Karan Singh,Counsel for complainant, has appended a note on the application itself that he has no objection if the application is allowed. 

2.         Keeping in view the facts mentioned in the application as well as no objection given by counsel for complainant, the application is allowed and the order dated 27.11.2012 is set aside to the extent OPs were proceeded as ex-parte.

3.         Previous costs of Rs.2500/- has been paid to counsel for complainant by Area Manager of OP No.1.

4.         Sh.Jaspinder Singh, Area Manager of OP No.1 has placed on file true copy of his Identity Card and made the following statement, recorded separately:-

“The OP No.1 offers to pay a sum of Rs.5,92,000/- to the complainant in full and final settlement of the dispute. The above said amount shall be paid to the complainant within 15 days from today.”

 

5.         Sh.Karan Singh, Counsel for Complainant has accepted the offer and made the following statement, recorded separately:-

“I have gone through the statement made by Sh.Jaspinder Singh, Area Manager of OP No.1-Standard Chartered Bank. I accept the offer. The complaint be disposed of accordingly”

 

6.         In view of the statements made by the parties, it is ordered that OP No.1 shall pay a sum of Rs.5,92,000/- to the complainant in full and final settlement of the dispute within 15 days from today, failing which the OP No.1 shall be liable to pay the said amount alongwith interest @ 18% p.a. from today i.e. 19.12.2012 till the date of payment.

7.         Hence, the complaint is disposed of accordingly.

8.         Certified copy of this order be communicated to the parties free of cost. After compliance file be consigned.
