During the course of arguments, it has come to light that complainant has sought relief in the complaint for getting the report of CIBIL cleared from defaulter list regarding credit card payment repaid to the opposite party. Opposite party in their written version has categorically mentioned that amount pertaining to the complainant has been written off by the opposite party bank on 17.6.2005 and nothing is payable by the complainant to the opposite party. As such, complaint has become infructuous as the relief sought by the complainant has already been cleared by the opposite party. As such, present complaint is disposed of being infructuous. Copy of the order be furnished to the parties free of costs. File is ordered to be consigned to the record room.
