Hence, it is

Ordered,

That the complaint be and the same is allowed on contest against the op with cost of Rs. 10,000/-.

For harassing the complainant and also for causing mental pain and suffering and further financial loss, op/Bank shall have to pay a sum of Rs. 15,000/- to the complainant as compensation.

For adopting deceitful manner of trade by stating falsely that no Deed of Conveyance or IGR was deposited and also for not supplying of statement of account etc. time to time as per RBI guide line in case of Housing Loan and to stop such sort of trade practice by the op in future, op shall have to pay Rs. 25,000/- as punitive damages to this Forum.Complainant shall deposit Rs. 40,000/- to the loan account immediately within 45 days from the date of this order to the op’s Bank and op Bank shall have to receipt it and then and there issue No Loan Certificate and to handover the original Deed of Conveyance in respect of the case flat and it must be made within one month from the date of receipt of Rs. 40,000/- from the complainant.

Op shall have to comply this order positively within 45 days from the date of this order, failing which for non-compliance of the Forum’s order and for harassing the complainant further penal interest at the rate of Rs. 200/- per day shall be assessed till full satisfaction of the decree and on payment of Rs. 40,000/- pay by the complainantto the op, the loan account shall be treated as finally closed and then and there op shall have to issue No Loan Certificate and handover the said original Registered Deed of Conveyance in respect of the flat.

Even if it is found that op is reluctant to comply the order, in that case, penal action shall be started against the op for which op shall be prosecuted u/s 25 read with 27 of C.P. Act 1986, for which further penalty and fine shall be imposed upon op.
