NAWAB SINGH, J. (ORAL)

 

First Appeal No.1053 of 2015 titled ‘Manju Sharma Versus M/s SRS Real Estate Limited, Faridabad’ was decided by this Commission vide order dated April 26th, 2016.

2.      Against the said order, Manju Sharma-complainant filed Revision Petition No.2220 of 2016 before Hon’ble National Consumer Disputes Redressal Commission, New Delhi. Vide order dated September 20th, 2017, the revision petition was allowed, the order of this Commission was set aside and the matter was remanded back for deciding the appeal including the dispute of liability of petitioner (Manju Sharma) to pay any amount to the respondent (SRS Real Estate Limited), after hearing the parties. The parties were directed to appear before this Commission today, that is, October 23rd, 2017.

3.      None has appeared on behalf of Manju Sharma-complainant.

4.      Shri Naveen Ladwal, Advocate appearing for SRS Real Estate Limited-respondent has placed on record Full and Final Settlement (Annexure-1), whereby, the matter has been settled between the parties and it was stated by Manju Sharma as under:

“We undertake to withdraw any pending litigation initiated by us against the company in respect of the aforesaid flat including the complaint pending adjudication before Hon’ble State Consumer Disputes Redressal Commission, Panchkula.

We further agree and confirm that in view of the above full and final settlement between us and the Company we are left with no claims/grievances/disputes against the Company or any of its officials, in respect of aforesaid flat.”

 

5.      In view of Full and Final Settlement (Annexure-1), the matter stands disposed of accordingly.
