Shri Santosh Kumar Ojha, Member: - Brief fact of the case is that, the complainant has availed loan of Rs.3,00,000/- only from the O.P on execution of loan agreement in the month of June’2013 to be repaid within January’2019 in monthly installments with interest against his vehicle NO. OR-15J-1863. Due to non-supplying of copy of agreement and proper calculation of loan the complainant is not able to know the actual dues and demanding Rs.2,50,000/- only apart from the future installments for which the complainant alleging deficiency in service and filed this case.
The O.P after appearance submitted that the complainant has taken loan of Rs.3,00,000/- and he is defaulter of paying installments. The complainant is in due of Rs.4,80,680/- only up to dtd. 14.11.2017 and prayed that the case is liable to be dismissed.
On perusal of record it is found that the complainant has taken financial help of Rs.3,00,000/- only from the O.P which was to be returned with interest from dtd. 18.06.2016 to 20.01.2019 and also taken two another loans of Rs.22,100/- and Rs.46,577/- only. On dtd. 14.11.2017 the complainant was liable to pay Rs.4,80,680/- only including arrear and other charges. But as the O.P has not supplied the copy of agreement the complainant is put in dark on his loan account which the complainant is entitled to get.
On the above facts and circumstances, the complaint of complainant is hereby allowed with directions to the O.P to provide the copy of Agreement executed between the parties along with afresh statement of accounts to the complainant within 15(fifteen) days from the date of receipt of this order and receive the legitimate dues amount from the complainant.
Accordingly the present case is disposed of.
Order pronounced in the open court today the 5th day of September’ 2018. Free copy of this order shall be supplied to the parties as per rule.
