In the matter of an application filed by the complainant alleging deficiency of service against the Opposite Parties under Consumer Protection Act, 1986.
A brief fact of the case is that, this matter was put up on 08.08.2019 for order. However, the order could not be prepared by that time and in the meanwhile the tenure of Presiding Officer & Member determined. So, notice was issued afresh to the both the parties on 24.05.2022. In the last 4 date of posting, the complainant was absent. In the last date the counsel of the complainant was contacted over phone & directed him to take part in hearing on 18.04.2023 positively. Despite all these, neither the complainant nor his counsel appeared today. They are also absent on call. It seems the complainant is not interested to pursue the litigation any further. The consumer complaint is a five years old complaint. So the complaint is dismissed for default of the complainant.
This order is pronounced in the open Court on this the 25th day of April 2023 under my hand and seal of the Commission.
