           Aggrieved by the order in C.C.No.104/2007 on the file of District Forum, preferred this appeal.

           The appellant, party in person, submitted that if the opposite parties have refunded the amount when he asked for refund, he would have purchased another plot somewhere in the city and would have earned good market value for the said plot.

We rely on the judgement of the Supreme Court inreported in  

Therefore, keeping in view the above judgements, we are of the considered that the complainant is entitled to a higher rate of interest at 15% p.a. 

In the result this appeal is allowed in part and the order of the District Forum is modified by directing the respondents/opposite parties to refund Rs.49,625/- with interest at 15% p.a. from 8-7-2004 till the date of realization together with compensation to Rs.25,000/- and costs to Rs.1,000/-.
