Final Order / Judgement

R.P. 30/2022

M.C.323/2022

Heard the learned counsel for the petitioner. It is submitted by the learned counsel for the petitioner that this Commission has already passed the order on dtd.22.02.2022 not to issue NOC till final disposal of the complaint case  but ignoring that  order  learned District Commission passed the order on 30.04.2022  to grant NOC within two weeks. So, he submitted to set-aside the said impugned order.

Considered the submission of learned counsel for the petitioner, perused the materials on record. It appears that learned District Commission have passed   the order in earlier occasion to issue NOC or not to take any coercive action against the complainant.  It appears that this Commission  vide order dtd 22.02.2022 interfered with  that order  and passed order not to issue NOC pending disposal of interim application.  Whether the order is placed before the learned District Commission or not but the fact remains that learned District Commission again has directed  to issue NOC. Therefore, such order can not be sustained in law. Thus, the impugned order dtd.30.04.2022 and order of this Commission  dtd 22.02.2022  passed by this Commission  be  brought to the knowledge of District Commission who  is to  go ahead  with the complaint case  and dispose of the complaint case within a period of 45 days from the date of receipt of this order. Learned counsel for the petitioner is directed to produce the  copy of this order on 27.06.2022  before the learned District Commission to pass appropriate order by the learned District Commission.

The Revision petition is disposed of accordingly.

Free copy of the order be supplied to the respective parties or they may download same from the confonet  or webtsite of this  Commission to treat same as copy of order received from this Commission.
