An application has been moved on behalf of the appellant for withdrawal of this appeal, with liberty to file fresh appeal.  It is further prayed in the application that the demand draft submitted towards mandatory deposit, be returned.

Learned counsel for the appellant submits that all necessary facts could not be inadvertently incorporated in the memo of appeal, hence he wants to withdraw the appeal with aforesaid liberty.

Accordingly, appeal is dismissed as withdrawn, with liberty to file fresh appeal according to law.  The demand draft submitted by the appellant towards mandatory deposit, be returned to learned counsel for the appellant in original, after retaining a photocopy of the same on record.
