Behera, President :- The brief facts of the complaint case is that, the complainant is a consumer of the O.Ps. bearing Consumer No. 413512060937 having electrical meter No. 964607 and he was paying the electricity bills regularly to the O.Ps as per supplying of electricity bills till October,2012. Afterwards the O.Ps. were in habit of supplying irregular and inflated bills to the complainant about which the O.ps. protested many times to the O.Ps. The O.Ps. installed a new electric meter bearing No. 733124 in the month of November,2012. After replacement of old meter the complainant did not receive any monthly electrical bills from the O.Ps.. The complainant approached to the O.ps. where the O.Ps. assured to issue bills after rectifying the defects in the system but the complainant not yet receive any electric bill. Due to non-supplying of electric bill the complainant is unable to make payment regularly. The complainant has paid Rs.1,45,000/- only towards electric bills since the date of installation of new meter which is excessive amount then that of regular bills. Without supplying of electric bills the O.Ps. threatening to disconnect the electric connection, hence this case.
On service of notices, the O.Ps. appeared and filed Written Version through his counsel admitting the facts of electricity connection and submitted that the complainant as not paying electric bill regularly and there were provisional billing for only 67 to 216 units upto November,2012 and bills are raised after installation of new meter. The complainant was paying part payment against arrear dues and it has accumulated to Rs.2,40,384/- only till June,2016. To avoid the liability of outstanding dues the complainant filed this case.
There was no such disconnection of power supply at any point of time on instruction of any authority of O.ps. without serving demand / dis connection notice on the complainant. Further after receipt of notice in the present complaint the O.Ps. have taken action for re-verification for actual billing period only with physical verification of the power supply of the complainant for any required correction of said bills with denying all allegations made by the complainant and prayed for dismissal of the case.
Heard the matter in length from both the parties, gone through the case and materials available on record. The complainant is a consumer of O.Ps bearing consumer No. 413512060937. The complainant filed Xerox copies of several Money Receipts of electricity bill. The O.Ps. filed the copy of consumers ledger verification records dtd. 27.08.2016. The complainant has availed electricity connection of having load capacity of 2.00 KW. The said verification report has been generated since April,2010 to June,2016. As per such verification report the electric meter has changed three times since April,2010. Last meter change in the month of February,2016. On perusal of said verification Report it is found that the meter reading was zero ( 0 ) upto October,2010 and in November,2010 meter reading was 1511. There were 67 units per month from April,2010 to October,2010 and from December,2010 to October,2012 there were 216 units per month and the meter reading were still continuing zero ( 0 ) up to November,2012 but in December,2012 meter reading was 9138 so also 10291, 12203, 14778 in the consecutive months. The meter reading was again zero in the month of March,2015 and continued upto January,2016. In the month of February,2016 the meter reading was 799, 1496, 2119 in the consecutive month. The complainant has started payment since January,2013 and paid in different dates. Up to June,2016 the complainant has paid Rs. 1,72,500/- only in different dates and after all the adjustment the complainant is in due of Rs.2,40,384/- only upto June,2016.
As per the above observation and analysis it is cleared that the meter readings were previously showing zero (0 ) for few months and suddenly enhanced to an unexpected units on which the O.Ps. failed to explain. As per the ledger verification report the complainant is paying as part payments without knowing the actual electricity bill amounts which it is the duty of O.Ps to issue regular actual bills to the complainant so that the complainant can be able to pay for the same.
On the above observations and analysis the complaint petition is allowed with directions to the O.Ps to make revision in the electricity bills of the complainant and issue afresh electricity bill after due adjustments so also issue regular monthly electricity bills as per actual meter readings. The O.Ps. are directed to pay a sum of Rs.2,000/- (two thousand) only to the complainant towards harassment and litigation costs.
Accordingly the case is disposed of.
Order pronounced in the open court today the 18th day of January’ 2017 and copy of this order shall be supplied to the parties as per rule.
