Accused A. Shamsiya Naaz, W/o. Abdul Hadi Shareef, Aged about 31 years, Medical Officer, PHC, Kaiwara, and the Complainant are present. Sri. R.A. Mohan files power for the Accused and files Memo with certain documents. Accused does not complain any ill treatment.  Both want that plea be recorded.  Hence, Plea is recorded and accepted. 

It is seen that in CC No. 186/2009 on 10.06.2010 this Forum has directed the accused who is OP2 to deduct certain amount from the salary of Sri. Gangaramaiah and to pay to the Complainant/DHr.  But OP2 has not deducted the amount and paid to Complainant. Accused submits that JDr-1 is not coming since 01.03.2012.  Earlier person had not deducted the amount fro the salary.  However, now Rs.4,650/- i.e., TA allowance of the said person is deducted by the accused and now paid to the Complainant/DHr who receives it. Another amount of Rs.13,190/- towards salary for the month of Feb. 2012 with respect to the said person and accused submits that she is going to pay the said amount to the Complainant/DHr through Cheque within 2 days.  The said statement is recorded.  Accordingly, we pass the following order:

ORDER

NBW is recalled.

Accused is convicted for the offence punishable u/s. 27 of the C.P. Act and sentenced to pay fine of Rs.2,000/-, in  default, to undergo simple imprisonment for 3 months. As and when JDr-1 attends to his duty accused has to recover the amount and to be paid to the Complainant/DHr.
