The instant case was filed by complainants U/S 12 of the C.P. Act, 1986 wherein the complainants have prayed for direction upon the o.ps. to refund the advance booking amount and to pay compensation of Rs. 1 lac together with litigation costs as the O.Ps. of Guddy Tour and Travels in spite of receiving Rs. 22,000/- from the complainant nos. 1 & 2 on 19-04-2011 for advance booking payment of air charges for a trip of five nights and five days for a tour to Port Blair Andaman together with Rs. 10,500/- from complainant no. 3 did not confirm the date of journey and ultimately informed on 03-05-2012 that the O.Ps. were not able to conduct the tour. 2. Notices were issued to the O.Ps. but those were received back with the postal endorsement ‘left’. Inasmuch as the O.Ps. did not leave any proper address in their erstwhile residence, the postal endorsement ‘left’ tantamounts to a good service in view of the decision of the Hon’ble Court. So the complaint heard ex parte. 3. Upon pleading of complainants two points arose for determination : i) Is there any deficiency in service on the part of the O.Ps. ? ii) Whether the complainants are entitled to get any relief as prayed for ? DECISION WITH REASONS : 4. Both the points are taken up together for consideration. From the enclosures it is apparent that the O.Ps. received Rs. 22,000/- by cash from the complainant nos. 1 & 2 as air charges for the trip to Port Blair Andaman and also Rs. 10,500/- by cheque no. 577075 from complainant no. 3. On repeated requests the O.Ps. did not inform the complainants of the confirmed date of journey and ultimately on 03-05-2012 they expressed their inability to conduct the tour. 5. In view of the unchallenged testimony ( photo copies ) we are of the view that the O.Ps. are responsible for gross deficiency in service and therefore, it is fit case where the prayer of the complaint shall be allowed. Hence, O R D E R E D That the C. C. Case No. 35 of 2013 ( HDF 35 of 2013 ) be and the same is allowed ex parte with costs against O.Ps. The O.Ps. be directed to refund the sum of Rs. 32,500 ( Rs. 22,000 + 10,500) to the complainants together with the interest @ 9% per annum within 30 days from the date of this order failing the amount shall carry interest @ 12% per annum till full satisfaction. The o.p. do also pay a sum of Rs. 30,000/- for causing mental pain and prolonged harassment to the complainants. The complainants are also entitled to a litigation cost of Rs. 3,000/-.
