ORDER

The instant appeal is filed against the order dated 05.12.2018 passed by the learned District Consumer Disputes Redressal Forum, West Tripura, Agartala in Case No.C.C.48 of 2018 whereby and whereunder the learned District Forum rejected the petition filed by the opposite party-Bank, the appellant herein, praying for accepting the written statement which has already been submitted on that day.

The appeal was admitted earlier and the notice was issued to the respondent-complainant.

Ld. Counsel, Mr. Arindam Ray has appeared on behalf of the respondent-complainant, Subrata Debnath and raised the question of maintainability of the appeal.

At this stage, Mr. M.K. Arya, Ld. Advocate appearing for the appellant wants to withdraw the appeal with a liberty to file afresh in accordance with law.

Such prayer of Mr. Arya is not objected by Mr. Ray, Ld. Counsel for the respondent-complainant.

In view of the above, the instant appeal is disposed of as withdrawn with a liberty to file afresh in accordance with law, if so advised.
