F I N A L O R D E R
1. The instant case was filed by complainant U/S 12 of the C.P. Act, 1986 wherein the complainant has prayed for direction upon the o.p. to complete the pending works and to pay compensation to the tune of Rs. 80,000/- and Rs. 10,000/- as litigation costs as the o.p. in violation of the development agreement dated 01-01-2009 did not complete the two flats measuring 350 sq. ft. in the 1st floor of the newly constructed building and did not pay Rs. 1 lakh as per the agreement.
2. In spite of service of proper notice, the o.p. did not file any written version. So the case was heard ex parte.
3. Two points require to be determined namely 1 & 2 :
i) Is there any deficiency in service on the part of the O.P. ?
ii) Whether the complainant is entitled to get any relief as prayed for ?
DECISION WITH REASONS :
4. Both the points are taken up together for consideration. From the enclosures it appears that the complainant is the absolute owner of the landed property measuring about 1 cottah 7 chittaks 9 Sq. ft. situated at municipal holding no. 19/2, Baishnab Para Lane, P.S. Shibpur, District – Howrah. As per agreement the o.p. as promoter / developer assured the complainant, a widow, to provide two flats together with Rs. 1 lakh. The o.p. turned a deaf ear to the repeated requests of the complainant. Therefore, it appears to be a fit case where the prayer of the complainant shall be allowed ex parte. Both the points are accordingly disposed of.
Hence,
O R D E R E D
That the C. C. Case No.412 of 2013 ( HDF 412 of 2013 ) be and the same is allowed ex parte with costs against the O.P.
The O.P. be directed to deliver the complainant two complete the flats measuring 350 sq. ft. as per agreement and to pay Rs. 1 lakh within 30 days from the date of this order
The o.p. do further pay a compensation of Rs. 50,000/- for causing mental pain and prolonged harassment together with litigation costs of Rs. 5,000/-.
The complainant is at liberty to put the decree into execution after expiry of the appeal period.
Supply the copies of the order to the parties, as per rule.
