F I N A L O R D E R
1. The instant case was filed by Smt. Surya Das, complainant U/S 12 of the C.P. Act, 1986, against Sri Palash Battacharya,O.P. alleging deficiency in service.

The complainant filed this petition praying for direction upon the O.P. to replace the defective chimney or to back a sum of Rs. 19,000/- together with damages as the machine since after purchase on 30-08-2010 is defective. All the assurances on the part of the O.P. turned vague and the complainant has suffered lot for deficiency in service on the part of the service provider, O.P.
3. The O.P. received the summons and entered appearance on 18-03-2011 and prayed for time to file written version. But ultimately the O.P. did not file any written version nor replaced the defective chimney in spite of repeated requests.
4. On perusal of the petition and the documents ( photo copy ) relied upon it is reflected that the O.P. received Rs. 19,000/- issued a receipt on 30-08-2010. The photo copy of the pass book of the complainant of the Indian Bank reflects that the cheque was encashed on 01-09-2010. Therefore there cannot be any doubt that the O.P. received the amount i.e. Rs. 19,000/- as a price for the chimney. There is further no doubt that the same is defective and in spite of several assurance on the part of the O.P. the same was not replaced and therefore, deficiency in service crept in. Though we are in the dark with respect to the brand in the chimney, we are of the view that in view of the unchallenged documents, the complainant is entitled to the relief as prayed for.

O R D E R E D
That the HDF . Case No. 11 of 2011 be allowed ex-parte with a cost against the O.P. Palash Bhattacharya, proprietor of Reliable Services.
The complainant is entitled to a sum of Rs. 19,000/- from the O.P. for deficiency in service and a further sum of Rs. 10,000/- as damages for placing the complainant for hardship since 30-08-2010. The complainant is further entitled to a litigation cost of Rs. 3,000/-.
That the O.P. do pay the same i.e. Rs. 19,000 + 10,000 + 3,000 = Rs. 32,000/- to the complainant within 30 days from the date of this order failing the sum shall carry interest @ 10% per annum till full satisfaction.
The complainant is at liberty to put the decree into execution after the statutory period.
Supply the copy of this order to the parties, as per rule.
