1.                  The instant case was filed by complainant, Smt. Mitra Roy  U/S 12 of the C.P.

Act, 1986 wherein the complainant has  prayed for direction upon the o.ps. to execute and register the deed of conveyance in respect of the schedule mentioned property and to pay compensation of Rs. 1 lac and litigation costs of Rs. 50,000/- as the O.Ps. inspite of receiving Rs. 4,05,000/- out of  the total consideration of Rs. 12,00,000/- did not execute and register the proper sale deed in favour of the complainant violating the agreement dated 20-02-2012

 

2.                  The o.p. no. 1 in the written version contended interalia that the O.P.. no. 2 has

been standing in the way of execution of registration as she has canceled the power of attorney.

 

3.         Upon pleadings of both parties two points arose for determination :

 

i)          Is there any deficiency in service on the part of the O.Ps.  ?

ii)                  Whether the complainant is  entitled to get any relief as prayed for ? 

 

 

DECISION  WITH   REASONS      :

 

 

4.      Both the points are  taken up together for consideration. The O.P. no. 1 admitted

the present position of the complainant specially paras 9 & 10 of the complaint. It is also the admitted position that the O.P. no. 1 received Rs. 4,05,000/- as part payment out of the total consideration money of Rs. 12,00,000/-. If there is any dispute between O.P. nos. 1 & 2 the complainant shall not suffer. He is ready to pay the balance amount for causing registration. Therefore, it is a fit case where the prayer of the complainant shall be allowed. Both the points are accordingly disposed of. 

 

 

      Hence,

                       

O     R     D      E      R      E        D

     

 

      That the C. C. Case No. 229 of 2013 ( HDF 229 of 2013)  be  and the same is allowed on contest with  costs  as against  the O.P. no. 1 and allowed ex parte with costs against the O.P. no. 2.  

 

      The O.P. no. 1 be directed to complete the incomplete works of the flat within 15 days from this order.

 

      The O.P. no. 1  be  further directed to execute and register the proper deed of conveyance in favour of the complainant with respect to the flat mentioned in the schedule after receiving the balance amount  and the O.P. no. 2 shall the confirming party during registration process  within 30 days from the date of this order.

 

      No order as to compensation.

      The complainant is  also entitled to a litigation cost of Rs.  5,000/- from the O.P. nos. 1 & 2. .

      The complainant is at liberty to put the decree into execution after expiry of the appeal period.

       

      Supply the copies of the order to the parties, as per rule.
