Counsel for the complainant and Op have filed a joint memo stating that Op out of the advance amount received he is due Rs.1,10,000/- and that Op has agreed to pay interest @ 16% p.a from 02/08/2010 till the date of payment.   Counsel for the complainant conceding the said fact has agreed to receive the said amount of Rs.1,10,000/- with interest as stated above and submitted to dispose the complaint accordingly.

        In view of the joint memo filed, we pass the following order.

                                        O R D E R      

        Complaint is allowed.

        Op is directed to refund Rs.1,10,000/- to the complainant with interest @ 16% p.a from 02/08/2010 till the date of payment and he shall pay that amount with interest within one month from today.   Failing which he shall pay interest @ 18% p.a from the date of this order till the date of payment.

        Parties to bear their own cost.
