This complaint filed by Smt.H.P. Shanthi, Proprietor of Kannika Home Stay, Kumaralli Village, Somwarpet Taluk against the opponents Mr. K.M. Devaiah, Proprietor: Coorg Dial, Trip V Go, Madikeri  and Mr.Santhosh Kumar, Proprietor : Trip V Go, Somwarpet Town, Kodagu District  on the allegations that she has published her Kannika Home Stay advertisement in website run by Mr. Arun to attract the tourists.  For the last two years there are decrease in number of tourists for stay in Kannika Home Stay.  The complainant came to know that the opponents  with intention to cheat her by removing the Kannika Home Stay phone numbers included their phone numbers and attracted tourists.  The complainant said to have sustained loss of Rs.5,00,000/- during the period of two years.

        The complainant prayer is that direct the opponents to pay Rs.5,00,000/- as compensation and direct to insert her phone numbers in place of opponents in the website run by Mr. Arun.  The complainant alleged cheating against the opponents and further she has not included the owner of website i.e. Mr. Arun who might have assisted the opponents to insert their phone numbers in

Place of Kannika Home Stay phone numbers.  In the absence of Mr. Arun complaint is not maintainable.  Secondly, this Forum is not having  jurisdiction to decide the issue of cheating.  On account of the above two grounds, the complaint is not maintainable.  Accordingly we proceed to pass the following;

O R D E R

    The complaint filed by Smt. H.P. Shanthi is dismissed as not maintainable.
