ORDER

The instant appeal is filed by the Senior Divisional Manager, New Indian Assurance Company Ltd. under section 15 of the Consumer Protection Act, 1986 against the judgment dated 01.11.2016 passed by the Ld. District Consumer Disputes Redressal Forum, West Tripura, Agartala in Case No.CC-74 of 2016 ex parte against the appellant New India Assurance Company Ltd.

Today the matter is fixed for hearing.

Heard Mr. A. Das, Ld. Counsel appearing for the appellant, New India Assurance Company Ltd. as well as Ms. K. Roy, Ld. Counsel appearing on behalf of the respondent-complainant, Shri Joydeb Saha and raised the question of maintainability of the appeal.

Mr. Das, Ld. Counsel appearing for the appellant wants to withdraw the appeal with a liberty to file appropriate petition before the appropriate Forum.

Prayer is allowed.

The instant appeal is disposed of as withdrawn with a liberty to the appellant, New India Assurance Company Ltd. to approach the appropriate Forum in accordance with law.
