Bantra, Howrah, being carried a business of developer under the name and style of Astha Developer as proprietor, having its office at 2/1, Makardaha Road, P.S. Member : Shri P.K. Chatterjee. Member : Smt. Jhumki Saha. F I N A L O R D E R 1. The instant case was filed by complainant U/S 12 of the C.P. Act, 1986 wherein the complainant has prayed for direction upon the o.p., Amit Hait to refund the principal sum of Rs. 7,50,000/- together with interest or alternatively to deliver possession of the ‘B’ schedule flat and to execute and register deed of conveyance as the o.p. in spite of repeated requests did not deliver the same though received Rs. 7,50,000/- pursuant to the agreement dated 27-04-2009. 2. The o.p. contested the case by filing written version contending interalia that for pendency of the civil suits on identical issue the flat as agreed upon could not be delivered. So the complaint should be dismissed. 3. Upon pleadings of both parties two points arose for determination : i) Is there any deficiency in service on the part of the O.P. ? ii) Whether the complainants are entitled to get any relief as prayed for ? DECISION WITH REASONS : 4. Both the points are taken up together for consideration. Admittedly the complainant paid Rs. 7,50,000/- to the o.p. on different dates vide agreement dated 27-04-2009. As complications arose and o.p. did not deliver the flat as mentioned in schedule, he has no way escape than to refund the entire money received together with the interest @ Rs. 12% per annum since 08-03-2009 ( vide IV (2009) CPJ – 51 NC). Both the points are accordingly disposed of. Hence, O R D E R E D That the C. C. Case No. 282 of 2013 ( HDF 282 of 2013 ) be and the same is decreed on contest as against the o.p. with costs. The O.P. be directed to refund the sum of Rs. 7,50,000/- to the complainant within 30 days from the date of this order together with interest @ 12% p.a. since 08-03-2009 failing the sum shall carry interest @ Rs. 18% p.a. till full satisfaction. The o.p. do further pay a sum of Rs. 1 lakh to the complainant as compensation for causing mental pain, harassment and frustration and Rs. 5,000/- as litigation costs.
