ORDER

Complainant has filed this case for direction to the O.P. Sri Vikas Kumar Regional Manager, Sahara India Service Centre – 1115 Bokaro Sahara Branch Office Sector-4, City Centre, Bokaro Steel City, Jharkhand for payment of Rs.4,77,550/- .

2          The case of the complainant in short is that complainant had deposited a sum of Rs. 4,77,550/- under Sahara Q Shop Unique Product Range Ltd., under Q shop plan H between the period of 01.06.2012 to 30.06.2012 and one plan 05.09.2012. The details of deposit receipt is as follows:-

            Complainant is in the need of money as such he requested The O.P. to return the matured amount but there was no effect. The complainant has also sent a legal notice on 04.07.2018 but payment has not been made, therefore, this complaint has been filed.

3          Some documents have been filed by the complainant as Annexures which is in record.

4          Notice has been issued to the O.P. on 24.08.2018 thereafter, O.P. appeared and filed Vakalatnama on 10.09.2018 along with a petition for time for filing W.S. but W.S. has not been filed. It appears that O.P. has nothing to say anything in this case, it shall be deemed to be an admission on the part of O.P.

F I N D I N G S

5          Heard the complainant and perused the record. We find that complainant has deposited money in the scheme of the O.P. and O.P. has promised to  provid services to its customer along with petitioner, as such petitioner is consumer. We find and hold that complainant is consumer and this case been filed within limitation.

            We also find that complainant has deposited Rs. 4,77,550/- by different receipts on different dates. The complainant has requested to the O.P. to pay the  maturity amount but he has not paid the amount to the complainant

Thereafter, complainant has given legal notice on 04.07.2018 in spite of that no payment was made to the complainant. Then the complainant has filed this case.

6          Accordingly, we hold negligence of the O.P. for not providing service as promise  and we direct the O.P. to pay maturity amount along with interest @ 10% per annum from the date of this order till realization.

            We further direct to pay Rs. 5,000/- as compensation for harassment to the complainant and Rs. 1000/- as litigation cost.

            All the payment must be paid within 60 days from passing this order, failing which the rate of interest shall be enhanced 18% per annum on main claim till realization.
