JUDGMENT
The facts of the complaint in brief is that the complainant intended to purchaser a vehicle and approached the OP to avail finance and the OP agreed and asked the complainant to deposit 1/3rd of the price of the vehicle i.e. Rs.5,00,000/- and asked the complainant to subscribe his signature on some pape5s purp0orted to be the application for availing the finance and the complainant paid the amount on 9.12.14 and the OP promised to arrange the finance and getting vehicle in his name and deliver the same at Rayagada. But the OP instead of purchasing the vehicle in the name of the complainant , the vehicle was purchased in his name ;and being asked he stated that he will deliver the vehicle at Rayagada and get the same transferred in his name. But he has not done so and not refunded the advance money of Rs.5,00,000/- and on being pressured he issued a cheque and the complainant presented the cheque which was returned back with endorsement as no fund available and the signature given on the cheque also not tallied. The complainant served legal notice but the OP refused a to accept the same. Hence, prayed to direct the OP to refund the money with interest and award compensation and cost of litigation. Being noticed, the Opp.Party did not turn up to file written version as such the Opp.Party was set exparte and in absence of any written version from the opposite party we proceeded the matter exparte and believed the contentions as alleged by the complainant against the and hence, we passed the order and disposed of the matter with the following directions.
ORDER
The Opposite Party - Sri Varadhi Srinivas Rao of New Colony, Visakhapatnam is directed to refund the advance amount of Rs.5,00,000/- with 9% interest and for causing mental agony and financial loss the OP is directed to pay Rs.5,000/- towards compensation and cost of litigation of Rs.500/- to the complainant, failing which the O.P is liable to pay 12% penal interest on the above awarded amount till its realization. Pronounced in open forum today on this 1st day of December,2016 under the seal and signature of this forum.
