None appears on behalf of the appellant/petitioner.
By order dated 6.7.2018, delay in filing the appeal was condoned subject to payment of cost of Rs.50,000/- by the appellant/petitioner to the respondent/complainant within a period of two weeks. On the basis of prayer made by the learned counsel for the appellant/petitioner time was granted on 26.7.2018, 21.2.2019, 13.3.2019 and 28.3.2019. By order dated 28.3.2019, the case was adjourned to today with an observation that failing to pay the cost by today, the Misc. Case shall stand dismissed.
Learned counsel for the respondent/complainant submits that cost has not been received by the respondent/complainant till today.
None payment of cost and non-appearance of the learned counsel for the appellant/petitioner indicates that the appellant/petitioner is not interested to pursue this case.
Accordingly, the Misc. Case stands dismissed for default.
