ORDER NO. 4 DT. 22.03.2011

Revisionists through Mr. P.K.Basu, OP No. 1 through Mr. B.Prasad and OP Nos. 2 & 3 through Mr. P.R.Bakshi, Ld. Advocates, are present.  Heard both sides at length.  Judgement/order is passed as under :-

 

This Revisional Application is taken up for hearing in presence of the parties concerned.  Evidently there is a Civil Suit being Title Suit No. 23 of 2000 pending between the present Revisional Petitioners and OP No. 1 and two others.  It is not in dispute that in the said Civil Suit by an interim order dt. 16.3.10 passed by the Court of Sub Divisional Civil Judge (Junior Division), Ghatal, the Defendant No. 3, i.e. West Bengal State Electricity Distribution Co. Ltd. (WBSEDCL) has been directed not to stretch overhead electric wire through or over the ‘Ka’ Schedule Suit Property, if not already stretched by 30.3.10.

 

In course of hearing of this Revisional Application it has transpired that the electric connection has not yet been given to the OP No. 1 namely Tilak Paria, till now, which clearly suggests that the overhead electric wire had not been stretched over the ‘Ka’  schedule property till before 30.3.10.

 

Having regard to the aforesaid facts and circumstances and more particularly, the fact that the above interim order is still in force and furthermore, by considering the order of disposal of the Complaint Case No. 164 of 2009 whereby the said WBSEDCL has been directed to give permanent electric connection along with a transformer to the submersible pump to the complainant, we dispose of the Revisional Application by holding and observing that permanent electric connection, if any, to the complainant shall be given by the said WBSEDCL by strictly observing the aforesaid interim order passed in said Title Suit No. 23 of 2010 by the Court of Sub Divisional Civil Judge (Junior Division), Ghatal.
