1.                  The instant case was filed by complainant U/S 12 of the C.P. Act, 1986

wherein the complainant has  prayed for direction upon the o.ps. to deliver the possession of the suit flat and to execute and register  the deed of conveyance in favour of the same and to pay compensation of Rs. 2,50,000/- together with  litigation costs of Rs. 20,000/- as the complainant in spite of the agreement dated 23-03-2011 and payment of the advance money of Rs. 10,000/- did not deliver possession with respect to the flat situated at Sapuipara, Basukati Gram Panchayat, P.S. Bally.

 

2.                  The o.p. in his  written version contended interalia that the complainant did not

produce the cheque for  Rs. 2,00,000/- but sent a xerox copy of the same on 02-11-2011 ; that the stipulated amount was not paid within the date as agreed upon; that the complainant has filed this complaint only to harass the O.P.

 

3.         Upon pleadings of both parties two points arose for determination:

 

i)          Is there any deficiency in service on the part of the O.P.  ?

ii)                  Whether the complainant is  entitled to get any relief as prayed for ? 

 

 

 

DECISION  WITH   REASONS      :

 

4.      Both the points are  taken up together for consideration. The agreement dated 22-

03-0211 unerringly shows that the O.P. agreed to sell the flat @ Rs. 1,000/- per sq. ft. and not Rs. 1,400/- per sq. ft. He also received Rs. 10,000/- as advance. The argument put forward by the O.P. that the complainant wrote the dates i.e., 23-03-2011 in the body of the agreement as per his sweet will is just fragile and cannot merit acceptance. It bears the signature of the O.P. in every page. So the O.P. cannot have any respite from the rigours of law. The complainant is ready to pay the balance amount. Therefore, it is a fit case where the prayer of the complainant shall be allowed. Both the points are accordingly disposed of.

 

Hence,                                    

O     R     D      E      R      E        D

 

           

      That the C. C. Case No. 111 of 2012 ( HDF 111 of 2012)  be  and the same is disposed of on contest with costs   against  the O.P. 

 

      The O.P. be directed to deliver the possession of the suit flat and to execute and register proper deed of conveyance with respect to the flat as mentioned in the agreement after receiving the balance from the complainant within one month from the date of this order.  

     

      The complainant be directed to pay up the balance amount within 15 days from the date of this order.

 

      No order as to compensation.

 

      The complainant is  also entitled to a litigation cost of Rs. 2,000/- from the O.P.

 

      The complainants are at liberty to put the decree into execution after expiry of the appeal period.       

      Supply the copies of the order to the parties, as per rule.
