Respondent is present through Ld. Advocate.  None is present on behalf of the Revision Petitioner.  On 01.10.2012 the Petitioner was directed to show-cause as to why the revision petition shall not be dismissed on the ground of default.  It is submitted by the Respondent that previously by order dated 10.08.2010 the RC/80/2010 was dismissed by this Commission and against that order the Petitioner herein moved before the Hon’ble National Commission by filing FA No. 247 of 2011 with I.A./1/2011 (for stay), I.A./2/2011 (for condonation of delay) and I.A./3/2011 (for exemption).  It is submitted by the Respondent that the application was dismissed by the Hon’ble National Commission with the observation that it would be open to the State Commission to consider further relief to be granted in view of the intervening developments and with this observation the appeal was disposed of accordingly.

 

The Hon’ble National Commission while disposing of the appeal with the application directed the Applicant to deposit the amount of sale price with the State Commission along with necessary documents about the sale of the vehicle.  It is submitted that the sale price has not yet been deposited by the Petitioner herein i.e. the Managing Director, Family Credit Limited and the MA Application filed by the Petitioner herein bearing No. 295/2011 was disposed of with the observation that since the direction has already been made by the Hon’ble National Commission there was no necessity to pass any further order in this respect.

 

Since the sale price of the vehicle has not been deposited with this Commission by the Petitioner herein, as submitted by the Respondent and the Petitioner having taken no step and being asked to show-cause having taken no step thereto we find that there is no necessity to drag this revisional application any more.  There is also no scope to pass any further order. 

 

It further appears that on 23.08.2012 MA/295/2011 filed by the Petitioner was disposed of.  Since there is no necessity to pass any further order no further date is required to be fixed.  The revisional application be treated as finally disposed of.
