Heard Mr. P.K. Das, learned counsel, appearing for the petitioner in the Misc case. As directed on 18-7-2014 Mr. Das has obtained a certificate from the Postal Authority, Guwahati Division, certifying therein that notice dated 20-3-2014 has been delivered to the respondent on 24-3-2014. Therefore, notice upon the respondent shall be deemed to have been completed. But none has appeared on behalf of the respondent.

            This is an application for condonation of delay of 193 days in preferring the connected appeal. We have perused the groundS stated in para 4,5 and 6 and we are satisfied that the appellant was prevented from filing the connected appeal in time. Accordingly, delay of 193 days is hereby condoned.

              In view of this order passed in this Misc Case, appeal shall be listed for admission on 3-11-2014.
