The Prop. MS Anjali Pollution Testing Center filed a consumer case on 30 Mar 2015 against Sri Sunil Das in the StateCommission Consumer Court. The case no is F.A 30/2014 and the judgment uploaded on 17 Jul 2015.
The learned counsel Mr.K.Nandi is present for the appellant. None appears for the respondent. It transpires that this Commission vide previous order dated 23.03.2015 directed the parties to remain present for the disposal of this appeal on the basis of the affidavit-cum-declaration submitted from the side of the parties to this appeal as submitted by the learned counsel for the appellant. Now Mr. Nandi submits that as the matter has been amicably settled between the parties, the appellant is not willing to appear in this appeal. He also submits that in view of the above position, the affidavit-cum-declaration submitted earlier for the disposal of this appeal may be rejected and the appeal may be dismissed on the ground of non-prosecution.
In this case, the respondent is also not appearing. Neither the appellant nor the respondent is coming to get this appeal disposed of on the basis of this said affidavit-cum-declaration. In the circumstances, we find no other ground to drag this appeal any more. As submitted by the learned counsel for the appellant, the affidavit-cum-declaration filed on 12.03.2015 not being pursued is rejected and the instant appeal is dismissed for non-prosecution as submitted.
