Appellant is absent on calls.  Respondent is present through Ld. Advocate Ms. Shampa Sengupta.  On behalf of the Appellant a Ld. Advocate appeared in the first call and asked for very short time to get her Senior to argue the matter.  But when the matter was called for the second time neither the Senior nor the Junior Advocate is available to advance argument.  We have waited for 10 minutes and it is 12.40 p.m.  It does not appear the Appellant is interested to proceed with the matter.  It may be noted that on the last date of hearing i.e. 14.10.2009 today’s date was fixed.  We do not find any reason for such conduct on the part of the Ld. Advocate for the Appellant to take short time to inform her Senior to appear and thereafter not even communicated the Bench about the developments.  Appeal is dismissed for default.
