After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder: -

The Complainant’s case is that she booked a flat for Rs.8,40,000/- with the O.P./Builders out of which she has paid Rs.1,60,000/- as earnest money under receipt but the O.P. could not deliver the flat for reason best known to them. Hence this case for refund of the earnest money with compensation.
O.P. contested the case by filing a written version praying for dismissal of the case on maintainability point.

-: Decision with reasons: -
Having regard to the facts of the case, submission, contention and documents on both sides the Commission finds that the Complainant has already paid Rs.1,60,000/- during the Year-2017 to the O.P./Builders supported by receipt but she did not get delivery of the flat as agreed upon by and between the parties. At the time of hearing Ld. Advocate for the O.P. has submitted before the Commission that they are unable to deliver the flat for obvious reasons but they are ready and willing to pay the earnest money to the Complainant and accordingly two (2) A/C. Payee Cheques for Rs.1,00,000/- & Rs.60,000/- have been handed over to the Complainant on proper receipt and identification. O.P./Builders has no further liability in the matter. However the O.P. has to pay compensation to the Complainant for Rs.10,000/- for delayed repayment.
Hence it is ordered……
That the case is allowed on contest but without cost.
O.P./Builders is directed to pay to the Complainant Rs.10,000/- towards compensation within a month from this date in default law will take its own course.
Both parties be supplied copy of this order free of cost.
